Welcome to Khojj (“we”, “us”, “our”, the “Company”). These Terms of Service (“Terms”) govern your access to and use of our website located at khojj.co and any of our related services (collectively, the “Services”). By using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. Eligibility
You must be 18 years of age or older (or the age of majority in your jurisdiction) to use the Services.
By using the Services, you represent and warrant that you have the legal capacity to form a binding contract.
2. Account Registration & Security
To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use or suspected breach.
3. Purchases & Payment
All purchases made through the Services are subject to product availability and acceptance of your order.
Prices are as displayed on the website, unless there is an obvious error. Sales taxes, shipping fees, and any other applicable charges are additional and will be clearly disclosed.
Payment is due at the time of purchase. We accept the payment methods displayed at checkout.
We reserve the right to refuse or cancel orders for any reason, including but not limited to: product or service availability, errors in pricing or product descriptions, or suspicion of fraud.
4. Shipping, Delivery & Returns
Shipping costs and delivery times will be as indicated at checkout.
Risk of loss for products passes to you upon our delivery to the carrier.
Returns and refunds are handled according to our Return Policy. You are responsible for reading and understanding the return policy before purchase.
5. Intellectual Property
All content on the website, including text, graphics, logos, images, product designs, and software, is owned or licensed by Khojj and is protected by copyright, trademark, patent, or other intellectual property laws.
You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any Content except as permitted in these Terms or with our prior written permission.
6. User Content
You may have the opportunity to post reviews, comments, or other content (“User Content”). By submitting User Content, you grant Khojj a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, distribute, prepare derivative works, display, and perform such content in connection with the Services and business.
You represent and warrant that: you own or have the necessary rights to your User Content; your User Content does not infringe any third-party rights; your User Content complies with all applicable laws.
We may remove or refuse to publish any User Content that we determine, in our discretion, is unlawful, offensive, harmful, or otherwise in violation of these Terms.
7. Prohibited Uses
You agree not to:
Use the Services in any way that violates applicable federal, state/provincial, or local laws or regulations.
Infringe upon the rights of others, including intellectual property rights or privacy rights.
Use automated systems (such as bots or scrapers) to access or use the Services.
Transmit spam or other unsolicited communications.
Interfere with or disrupt the integrity or performance of the Services.
Use the Services for any fraudulent or deceptive business practices.
8. Disclaimers & Limitation of Liability
AS IS / NO WARRANTIES. The Services (including all products and content) are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law.
LIMITATION OF LIABILITY. To the fullest extent permitted under law, Khojj, its affiliates, officers, directors, employees, agents, suppliers, and licensors will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or relating to your use of, or inability to use, the Services.
Our total aggregate liability to you for any claims arising under these Terms shall not exceed the amount you have paid to us in the past 12 months (or, if you have not made any purchases, USD/CAD $100).
9. Indemnification
You agree to defend, indemnify, and hold harmless Khojj and its officers, directors, employees, agents, affiliates, licensors, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:
Your breach of these Terms;
Your violation of any law or the rights of a third party;
Your User Content; or
Your use of the Services.
10. Termination; Suspension
We may suspend or terminate your access to the Services, or your account, without prior notice, for any reason, including breach of these Terms.
Upon termination, your rights to use the Services will immediately cease, but obligations that by their nature should survive termination (e.g. intellectual property, indemnification, limitation of liability) will remain in effect.
11. Governing Law & Dispute Resolution
For users in the USA: These Terms shall be governed by and construed in accordance with the laws of the State of Pennsylvania, without regard to its conflict of law principles.
For users in Canada: These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or your use of the Services shall be resolved through binding arbitration (you and we agree to waive the right to a jury trial and class actions) unless prohibited by applicable law.
Notwithstanding the foregoing, we may seek injunctive or other equitable relief in any court of competent jurisdiction for matters relating to protection of intellectual property or confidentiality.
12. Changes to Terms
We may modify these Terms at any time. When we do, we will revise the “Effective Date” at the top, and post the updated Terms on our site.
Your continued use of the Services after the Effective Date constitutes your acceptance of the modified Terms.
13. Miscellaneous
Entire Agreement. These Terms, our Privacy Policy, Return Policy, and any additional terms you agree to when using particular features constitute the entire agreement between you and Khojj relating to your use of the Services.
Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force.
Waiver. No waiver by us of any term or condition will be deemed a further or continuing waiver of such term or condition or any other term or condition.
Assignment. You may not assign your rights or obligations under these Terms, but we may assign them without restriction.
